Case Overview

On April 10, 2019, a private motor vehicle carrying several passengers, including a minor, was involved in a rear-end collision on Matamoros Street in Webb County, Texas. A commercial truck, operated by a defendant driver in the course of employment with a defendant trucking company, struck the plaintiffs' vehicle.

The plaintiffs filed a lawsuit on June 4, 2021, alleging the truck driver was negligent for failing to maintain a proper lookout, control speed, apply brakes, take evasive action, and driving at an unreasonable speed. The defendant trucking company was named under the doctrine of *respondeat superior*.
