Case Overview

On February 12, 2015, a rear-end collision occurred on the 9300 block of West FM 1960 in Houston, Harris County, Texas. The plaintiff was operating a vehicle when the defendant driver, operating a vehicle owned by the defendant owner, struck the rear of the plaintiff's car.

The plaintiff subsequently filed a lawsuit, alleging the defendant driver's negligence included failing to keep a proper lookout, failing to apply or timely apply brakes, failing to control vehicle speed, and failing to maintain an assured clear distance. The plaintiff claimed to have sustained injuries to the neck and back, necessitating diagnostic tests and chiropractic care, as a direct result of the collision.

The defendant admitted liability for striking the plaintiff's vehicle. However, the defendant denied that the plaintiff sustained any serious or permanent injury from the incident. After deliberation, a jury found that the plaintiff was entitled to $5,000 for past medical expenses.
