Case Overview

**Fort Worth, Texas** – A multi-vehicle collision on June 10, 2014, at the intersection of Magnolia Avenue and Hemphill Street in Fort Worth led to a lawsuit and a defense verdict. A plaintiff, stopped in a left turn lane on Magnolia Avenue, was struck when a second vehicle, traveling east on Magnolia Avenue, was hit by an uninsured motorist traveling north on Hemphill Street. The second vehicle then rolled over and collided with the front left of the plaintiff's vehicle.

The plaintiff claimed neck, back, and shoulder injuries and filed a lawsuit alleging negligence against the drivers of the other two vehicles. The plaintiff also sued the alleged owner of the uninsured vehicle for negligent entrustment and their own insurer, Auto Club, for uninsured/underinsured motorist benefits. The uninsured motorist and alleged vehicle owner did not appear in court.

During the trial, the plaintiff testified that the uninsured motorist had a green light, suggesting the other defendant driver had a red light. The defendant driver, however, maintained her light was green and argued that the uninsured motorist was solely responsible for the collision. Defense counsel challenged the plaintiff's credibility, noting inconsistencies between her ambulance complaints and trial testimony regarding immediate pain, and also disputed her claim of having to give up foster children due to injuries, as this detail was absent from her deposition. After a one-day trial, the jury deliberated for 30 minutes and returned a defense verdict, awarding no damages to the plaintiff.
