Case Overview

On July 3, 2013, a collision occurred at the intersection of Vilbig Road and Bickers Street in west Dallas, Texas. A northbound vehicle, which did not have a stop sign, was struck by a westbound vehicle. The westbound driver, who had a stop sign, entered the intersection, causing the collision. The northbound vehicle's two occupants, the plaintiffs, subsequently sued the westbound driver, the defendant, alleging negligence, including running a stop sign and failing to yield the right of way.

The defendant admitted responsibility for the accident, explaining she was unfamiliar with the area and mistakenly believed both streets had stop signs due to a pedestrian-crossing sign. The plaintiffs claimed neck and back sprains and strains, with one also alleging a concussion and post-concussion syndrome. Despite chiropractic treatment and diagnostic tests, including MRIs, all results were normal. Plaintiffs sought over $57,000 for past medical bills, plus future expenses, pain, and impairment. The defense countered that the absence of objective findings indicated no serious injury and questioned one plaintiff's credibility.

After a trial, a jury found the defendant negligent and awarded the plaintiffs a total of $17,000 in damages. This award was significantly lower than the amounts sought by the plaintiffs, suggesting the jury largely accepted the defense's arguments regarding the limited nature or extent of the alleged injuries.
