Case Overview

In February 2014, a rear-end collision occurred in Brownsville, Texas, when a sport utility vehicle struck another that was stopped at a red light. The driver and her passenger, who were in the struck vehicle, sustained back and neck injuries and subsequently filed a lawsuit.

The plaintiffs alleged that the at-fault driver was negligent in operating his vehicle and that his employer had negligently entrusted the vehicle to him. The defendant driver acknowledged partial responsibility, stating he stopped behind the plaintiffs, took his foot off the brake as they inched forward, and then could not stop in time when they halted again. The employer contended that despite the vehicle's title being in its name, the driver was purchasing it and was the true owner. Plaintiffs' medical experts testified that their injuries, including disc protrusions and an annular tear for the driver, were accident-related and required extensive treatment, with one plaintiff needing future lumbar surgery. Defense medical experts countered that the injuries were minor soft tissue, MRI findings were degenerative, and much of the treatment was excessive.

After a three-day trial, a jury found both defendants negligent. The jury awarded the plaintiffs a total of $19,600 in damages for past medical costs, past and future physical impairment, and past and future pain and mental anguish.
