On April 5, 2019, a 2004 Ford F150 pickup truck, towing a trailer, struck the rear of a 2008 Mack truck on Farm-to-Market Road 1463 in Fort Bend County, Texas. The driver of the Mack truck subsequently filed a lawsuit on March 11, 2021, against the driver of the Ford F150 and the owner of the Ford F150 and trailer.
The plaintiff alleged the Ford F150 driver was negligent for failing to control the vehicle, maintain a proper lookout, timely apply brakes, and control speed, among other claims, and violated Section 545.062 of the Texas Transportation Code. The plaintiff also claimed the vehicle owner was liable for negligent entrustment, asserting she knew or should have known the driver was negligent. Damages sought included past and future medical expenses, pain and suffering, mental anguish, physical impairment, disfigurement, and lost earnings. The driver defendant denied the allegations and asserted defenses for limiting medical and lost earnings recovery. The plaintiff later nonsuited the claims against the vehicle owner.
The case proceeded to a jury trial against the driver defendant in the 268th Judicial District Court. On June 2, 2022, the jury returned a unanimous verdict in favor of the plaintiff.
